On Saturday, Regent University School of Law Professor Tom Folsom was at the University of Houston Law Center presenting at the Works-In-Progress Intellectual Property Colloquium, sponsored by the Institute for Intellectual Property & Information Law. Prof. Folsom presented "Privateers in Cyberspace," discussing post-secondary liability and other unconventional remedies to enhance confidentiality, integrity, and availability of data in light of ubiquitous cyber-piracy. "There are only two types of companies," Folsom said, "those that have been hacked and those that will be hacked." Folsom proposed a two-step solution involving explicit liability for data custodians and "privacy trade-offs" that would allow easier identification of pirates.
